Washington has witnessed Democrats delivering a counteroffer on overhauling immigration enforcement to the White House and Republican leadership, marking another step in the ongoing talks about funding the Department of Homeland Security (DHS).

DHS funding lapsed on Saturday, putting ICE and CBP operations in a precarious position. Democrats have tied any new funding to reforms of ICE and CBP, citing two deadly shootings by federal agents during the recent immigration crackdown in Minneapolis as a turning point.

A short-term funding extension intended to buy negotiators more time collapsed without resolution late last week. While proponents from both sides have exchanged proposals and draft legislation, specifics of the latest Democratic offer were not immediately disclosed by late Monday.

With lawmakers currently on recess, negotiations continue behind the scenes. Congressional leaders have signaled that members could be recalled if a deal is reached, though optimism for a quick agreement has faded in recent days.

Senate Majority Leader Chuck Schumer reiterated Democrats’ positions in a Sunday interview, outlining three core objectives to rein in ICE and reduce violence: ending roving patrols and barring ICE agents from entering certain locations; establishing a formal use-of-force code for immigration enforcement; and requiring agents to wear body cameras while prohibiting the use of masks for agents. Schumer framed these as common-sense reforms that enjoy broad public support, accusing Republicans of withholding reasonable proposals.

Earlier in the month, Democrats released a longer list of demands. Some points—such as the body camera requirement—found some potential common ground with Republicans, but other items remained deeply divisive.

President Trump, speaking aboard Air Force One, indicated he would meet with Democrats this week to discuss DHS funding but cautioned that he did not agree with all the Democrats’ requests. He pledged to protect law enforcement and ICE during the talks.

The proposed prohibition on masks for federal immigration agents has generated substantial pushback from Republicans, who argue safety concerns necessitate masks. White House border adviser Tom Homan acknowledged the mask issue’s safety implications, noting that agents face rising threats and assaults and should be equipped to protect themselves.

For now, DHS funding remains in limbo. ICE and CBP continue to operate, aided by funds from the One Big Beautiful Bill Act passed last year, but the department’s broader programs—including the Transportation Security Administration, the Coast Guard, and FEMA—are affected by the shutdown. Most personnel in these agencies continue working without pay until a funding agreement is reached.

How long the shutdown lasts depends on whether a deal can be reached. If talks stall, lawmakers aren’t scheduled to return to Washington until February 23, just ahead of President Trump’s State of the Union address. When asked whether he would still deliver the address if funding isn’t resolved, the president indicated he would, saying the show would go on.
